How Proxy Bidding Increments Work

Most bids advance by the auction’s stated increment. When two or more private max bids are very close, the system may temporarily use a smaller amount than the posted increment so the bid history stays fair and clear without showing a bidder repeatedly bidding against themselves.

1. Binding Legal Agreement

By placing a bid, you enter into a legally binding contract to purchase the item at your bid price if you are the winning bidder. All sales are FINAL — no refunds, no returns, no exceptions. Failure to complete a purchase may result in a ban from all future auctions conducted by West KY Auctions.

2. Age Requirement and Valid ID

You must be at least 18 years old to participate in any West KY Auction. A valid state-issued photo ID, with driver’s license preferred, is required for buyers and sellers to participate and may be requested at any time to verify identity.

3. All Sales Final — No Refunds

All items are sold AS-IS, WHERE-IS, with no warranties expressed or implied. The auctioneer and seller make no guarantees regarding condition, authenticity, or fitness for a particular purpose.

4. Auction Cancellation or Restart

If a software glitch, technical error, auctioneer mistake, incorrect item description, or other material issue occurs, West KY Auctions may cancel or restart the affected auction at the auctioneer’s discretion.

5. Buyer’s Premium & Final Price

A 5% Buyer’s Premium is added to non-cash purchases. If payment is made in full with cash, the Buyer’s Premium may be waived through the current 5% cash discount. Kentucky sales tax will also be added when applicable.

6. Accepted Payment Methods

Buyers may pay with cash, CashApp, Venmo, PayPal, or other approved payment methods listed on the auction. Payment is due within 48 hours unless otherwise arranged in writing.

7. Pickup By Appointment Only

Pickup is by appointment only in Sedalia, KY 42079, generally the next Saturday or Sunday afternoon after the auction unless another time is arranged. Do not show up without a confirmed appointment.

8. Item Inspection

Items may be inspected before bidding by appointment only. To request inspection, contact 270-992-2093. Bidding without inspection means you accept the item as-is and sight-unseen.

9. Identity, ID, and Privacy

Bidders must use their real first name, last name, phone number, and email. We may ask you to show or provide a photo of a valid state-issued ID so we can keep it on file for future online or in-person bidding, buying, or selling. We do not sell or share your personal information or ID photos except when legally required, such as by court order or a theft/fraud investigation.

10. Reserve Price Auctions

Some auctions have a reserve price. If bidding does not reach the reserve, the item does not sell. Reserve amounts may be public or confidential. Sellers may choose a reserve before the auction goes live. The reserve listing fee is $1.00 per item unless otherwise agreed; if the reserve is met and the item sells, that reserve listing fee is not charged, but if the reserve is not met, the item does not sell and the reserve listing fee is charged.

11. Absolute Auction — No Reserve

Any auction marked absolute will sell to the highest bidder without reserve, and the seller may not bid or have someone bid on the seller’s behalf.

12. Seller, Family, and Household Bidding Prohibited

Sellers may not bid on their own items or have friends, family, household members, or anyone using the same IP address bid on their behalf.

13. Simultaneous Bids & Timestamp Resolution

If bids are received at nearly the same time, server timestamps determine priority. Bid your maximum amount to protect your position.

14. Auction Timer and Official End

For digital online auctions, the countdown timer is the official auction clock. When the timer reaches zero, the auction is officially ended and has the same legal effect as the auctioneer closing the auction. West KY Auctions may extend online auction time when needed to give bidders a fair chance to bid.

15. Future In-Person Auctions

West KY Auctions is currently online-focused, but may conduct in-person auctions in the future. If online bidding is offered during an in-person auction, that method will be decided case by case and advertised clearly for that auction.

16. Bidder Default

Failure to complete a winning purchase without documented cause may result in a ban from all future West KY Auctions events.

17. Necessary Updates and Fairness

If new material information is discovered after bidding starts, West KY Auctions may update the listing and notify prior bidders. If a bidder no longer wants their bid active because of the update, the auction may be cancelled and restarted for fairness.

18. Seller Commission and Fee Adjustments

Standard seller commission tiers are applied per item: Under $10 = 50%; $10.00 – $49.99 = 25%; $50.00 – $99.99 = 15%; $100.00 – $1,000.00 = 10%; Over $1,000.00 = 5%. Fees may be adjusted for a specific listing when agreed before the item is listed in an auction. Agreed listing-specific terms override standard site fees.
